The extreme Right Wing U.S. Supreme Court has a dilemma. They want to give Donald Trump absolute criminal immunity because…hail god emperor Trump and all that.
So what’s the dilemma? They very much don’t want to give that same criminal immunity to Biden while he’s in office because Dem’s bad and also this would include permission to assassinate political rivals at will, which could be bad for god emperor Trump and all that.
So their best case scenario is to try to get the timing perfect. Currently they are hearing oral argument in April 2024. Ideally they’d like to make their decision either just after election day or better yet right after inauguration 2025 if Donald Trump wins. Not sure they’ll be able to delay that long from oral argument in 2024 but this won’t be a legal decision. This will be a political decision from the most politicized Supreme Court we’ve ever had.
